These Terms and Conditions govern your access to and use of the Kitabu Yetu Platform, including its website, applications, software, payment services, communications services, and related products.
Please read these Terms carefully before using Kitabu Yetu. By creating an account, accessing the Platform, joining or managing a group, subscribing to a service, making a payment, or otherwise using Kitabu Yetu, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
If you do not agree with these Terms, you should not use the Platform.
1. The Kitabu Yetu Platform
Kitabu Yetu is a digital platform designed to help community groups, organizations, and ecosystem partners manage group administration, financial records, member information, communications, payments, and related activities.
The Platform may provide services and products including:
- Bookkeeper — digital group administration and financial record management;
- Chama Reminder — SMS and other communication tools for group reminders and notifications;
- Fundraise / Changi$ha — fundraising and campaign-related services;
- Enterprise — tools for organizations managing multiple groups or community programmes; and
- Other products, integrations, features, and services that may be introduced from time to time.
Kitabu Yetu may be operated by Kitabu Yetu, its affiliates, employees, contractors, technology providers, payment partners, communication providers, and other authorized service providers.
In these Terms, "Kitabu Yetu," "we," "us," or "our" refers to the operator of the relevant Kitabu Yetu service.
"You" or "your" refers to the person, group, organization, business, or other entity accessing or using the Platform.
2. Services Provided
Kitabu Yetu enables users to digitize and manage community-group activities through the Platform.
Depending on the product and subscription selected, the Platform may allow users to:
- register and manage members;
- maintain digital group records;
- record savings, contributions, loans, repayments, welfare and other transactions;
- manage group meetings and activities;
- track income-generating activities and investments;
- manage group expenses and financial records;
- communicate with members through SMS, email, or other supported channels;
- make or receive supported digital payments;
- generate reports and statements;
- manage multiple groups on behalf of an organization;
- administer funding programmes and allocations;
- manage fundraising campaigns;
- connect with participating financial, development, insurance, professional, or other ecosystem partners; and
- access other features made available by Kitabu Yetu.
We may introduce, modify, suspend, or discontinue particular features or services. Where reasonably practicable, we will provide appropriate notice of material changes.
3. Account Registration and Access
Certain Kitabu Yetu services require you to create an account or to be invited or onboarded by an authorized group or organization administrator.
You may be required to provide information necessary to establish and operate your account, including your name, contact information, identification information, group membership information, or other relevant details.
You are responsible for ensuring that information you provide is accurate, complete, and reasonably current.
You must keep your login credentials, passwords, authentication codes, and other security credentials confidential.
You must not:
- share your password or authentication credentials with unauthorized persons;
- allow another person to use your account without authorization;
- impersonate another person;
- create an account using false or misleading information; or
- attempt to gain unauthorized access to another user's account.
You should notify Kitabu Yetu promptly if you believe your account or credentials have been compromised.
4. Group and Organization Accounts
Kitabu Yetu may support different types of users, including individual members, group officials, group administrators, organizations, field officers, donors, and platform administrators.
Access to information and functionality may depend on the user's role and permissions.
For example, group officials may be authorized to manage group records, while members may have access to information relating to their own membership and financial activity.
Organizations managing multiple groups may have access to information relating to groups and programmes for which they have been authorized.
Users must only access information and functionality for which they have legitimate authorization.
A group or organization administrator is responsible for ensuring that individuals granted administrative access are appropriately authorized.
5. Lawful and Responsible Use
You agree to use Kitabu Yetu only for lawful purposes and in accordance with these Terms.
You must not use the Platform to:
- conduct unlawful activities;
- defraud or deceive another person;
- submit knowingly false or misleading information;
- misuse another person's personal information;
- interfere with another user's rights;
- circumvent security or access controls;
- gain unauthorized access to systems or information;
- introduce malicious software or harmful code;
- disrupt the operation of the Platform;
- use the Platform to facilitate money laundering, fraud, or other prohibited financial activity; or
- otherwise misuse the Platform or its services.
You remain responsible for complying with laws and regulations applicable to your activities, group, organization, business, or programme.
6. Group Records and User-Submitted Information
Kitabu Yetu may store information entered or submitted by users, group officials, organizations, or authorized administrators.
This may include:
- member records;
- group constitution and rules;
- contribution records;
- savings and share records;
- loan records;
- welfare records;
- fines and penalties;
- meeting records;
- payment information;
- financial transactions;
- communications;
- fundraising information;
- programme information; and
- other information required to provide the relevant service.
You are responsible for ensuring that information entered into the Platform is accurate and that you have the appropriate authority to submit it.
Where an error is identified, users should follow the available procedures for correcting the relevant record.
Kitabu Yetu may maintain audit trails or historical records to support accountability, security, dispute resolution, and financial record integrity.
7. Financial Records and Transactions
Kitabu Yetu provides tools for recording and managing financial information. Unless expressly stated otherwise for a particular service, Kitabu Yetu is a technology platform and does not itself become the owner of a group's funds merely because those funds or transactions are recorded on the Platform.
The accuracy of financial records depends in part on information supplied by users and authorized administrators.
Where Kitabu Yetu integrates with payment providers, banks, mobile-money services, or other financial service providers, the processing of a transaction may also be subject to the terms and conditions of the relevant provider.
Kitabu Yetu does not guarantee that every payment will be completed successfully, immediately, or without interruption.
A transaction may be delayed, rejected, reversed, cancelled, or otherwise affected by circumstances involving a payment provider, telecommunications network, banking system, regulatory requirement, technical failure, or other event outside Kitabu Yetu's reasonable control.
8. Payments and Transaction Charges
Kitabu Yetu may support payment methods including mobile money, bank cards, bank transfers, or other payment methods made available from time to time.
Charges may apply to particular products, subscriptions, transactions, communications, or other services.
Where applicable, you will be informed of the relevant charges before completing a paid transaction.
Payment processing may also incur charges imposed by a payment provider, telecommunications operator, bank, card network, or other third party.
You are responsible for applicable transaction charges unless otherwise stated.
Kitabu Yetu may change its pricing, plans, usage limits, or service charges from time to time. Where appropriate, changes affecting an existing subscription will be communicated before they take effect.
9. Subscriptions and Service Plans
Certain Kitabu Yetu products may be provided on a subscription basis.
Your subscription may determine:
- the features available to you;
- number of users or members supported;
- number of groups supported;
- communication allowances;
- storage or usage limits;
- reporting capabilities;
- organization functionality; and
- other service entitlements.
Subscription fees are payable according to the applicable billing terms.
Failure to make required payments may result in restriction, suspension, or termination of the relevant paid service, subject to any applicable notice or grace period.
10. Communications
Kitabu Yetu may send service-related communications through SMS, email, or other supported channels.
These may include:
- payment confirmations;
- contribution reminders;
- meeting reminders;
- account notifications;
- security alerts;
- service announcements;
- administrative communications;
- fundraising notifications; and
- other messages necessary to provide or administer the service.
Organizations and groups using Kitabu Yetu are responsible for ensuring that they have an appropriate basis and authorization for information they provide for member communications.
Additional charges may apply to certain communication services, including SMS or other usage-based services.
11. Personal Information and Privacy
Kitabu Yetu may collect and process personal information necessary to provide, secure, maintain, improve, and support its services.
The information processed may include account information, contact details, group membership information, transaction records, authentication information, and other information relevant to the services being used.
Personal information will be handled in accordance with Kitabu Yetu's Privacy Policy and applicable Kenyan data-protection requirements.
By using the Platform, you acknowledge that certain information must be processed in order to provide the services you request.
Where Kitabu Yetu processes information on behalf of a group or organization, the responsibilities of Kitabu Yetu and the relevant group or organization may depend on the nature of the service and the applicable data-processing arrangement.
12. Data Security
Kitabu Yetu will take reasonable technical and organizational measures designed to protect information held within the Platform against unauthorized access, loss, misuse, alteration, or disclosure.
However, no internet-based system can be guaranteed to be completely secure.
You are responsible for following reasonable security practices, including:
- using strong and unique passwords;
- protecting authentication credentials;
- not sharing passwords or verification codes;
- using trusted devices and networks where possible; and
- promptly reporting suspected unauthorized access.
You must not attempt to bypass, disable, compromise, or interfere with security controls implemented by Kitabu Yetu.
13. Malware and Cybersecurity
You must not introduce viruses, malware, ransomware, worms, trojans, logic bombs, malicious scripts, or other harmful material into the Platform.
You must not attempt to:
- hack the Platform;
- scan or probe systems without authorization;
- obtain unauthorized access;
- interfere with Platform availability;
- access another user's information without authorization;
- reverse engineer security controls for malicious purposes; or
- otherwise compromise the security or integrity of Kitabu Yetu.
We may suspend or restrict accounts involved in suspected security violations and may report unlawful activity to appropriate authorities where required or permitted by law.
14. Availability of the Platform
We will make reasonable efforts to keep Kitabu Yetu available and operational.
However, uninterrupted availability cannot be guaranteed.
The Platform may occasionally be unavailable or experience reduced functionality because of:
- maintenance;
- upgrades;
- security measures;
- infrastructure failures;
- internet outages;
- telecommunications failures;
- power interruptions;
- third-party service failures;
- payment-provider interruptions;
- cyber incidents; or
- circumstances beyond our reasonable control.
We may carry out scheduled or emergency maintenance where necessary to protect or improve the Platform.
15. Third-Party Services and Integrations
Kitabu Yetu may integrate with or rely on third-party services, including payment providers, mobile-money providers, SMS providers, email providers, hosting providers, authentication services, financial institutions, and other technology providers.
Your use of third-party services may be subject to their own terms and privacy policies.
Kitabu Yetu is not responsible for failures, interruptions, policies, or actions of third-party providers outside its reasonable control.
16. Intellectual Property
The Kitabu Yetu Platform, including its software, interfaces, designs, branding, logos, documentation, content, and underlying technology, is owned by or licensed to Kitabu Yetu and is protected by applicable intellectual-property laws.
Subject to these Terms and any applicable subscription agreement, you receive a limited, non-exclusive, non-transferable right to access and use the Platform for its intended purpose.
Your use of Kitabu Yetu does not transfer ownership of the Platform or its underlying intellectual property to you.
You must not reproduce, distribute, sell, sublicense, modify, reverse engineer, or commercially exploit Kitabu Yetu's software or intellectual property except where expressly authorized in writing or permitted by applicable law.
17. Your Data
Subject to applicable law and our Privacy Policy, information and records submitted by a group or organization remain associated with that group or organization.
Kitabu Yetu may process such information as necessary to provide, secure, maintain, improve, and support the relevant services.
You authorize Kitabu Yetu to use submitted information for legitimate operational purposes, including:
- providing the requested services;
- maintaining records;
- generating reports;
- providing customer support;
- detecting fraud and abuse;
- maintaining security;
- troubleshooting;
- improving the Platform; and
- complying with legal obligations.
Where applicable, additional agreements may govern ownership, access, retention, export, or processing of organizational data.
18. User Responsibilities
You are responsible for:
- the accuracy of information you submit;
- activities conducted through your account;
- maintaining the confidentiality of your credentials;
- obtaining necessary authorization from group members or other individuals;
- ensuring lawful use of the Platform;
- maintaining appropriate internal controls within your group or organization; and
- reviewing financial and administrative records for accuracy.
Kitabu Yetu provides digital tools to support administration and record keeping. It does not replace the responsibility of group officials, members, organizations, accountants, trustees, or other authorized persons to exercise appropriate oversight.
19. Suspension and Termination
Kitabu Yetu may suspend, restrict, or terminate access to an account or service where reasonably necessary, including where:
- these Terms are violated;
- unlawful activity is suspected;
- fraudulent activity is detected;
- there is a security risk;
- payment obligations remain unpaid;
- the account is being misused;
- continued access may harm other users or the Platform; or
- required by law or a competent authority.
Where reasonably practicable, we may provide notice and an opportunity to resolve the issue before suspension or termination.
Termination does not automatically remove obligations that arose before termination.
20. Data Following Termination
Following termination or expiry of a service, information may be retained for periods required by law, legitimate operational requirements, security, dispute resolution, accounting, or other lawful purposes.
Where applicable, users or organizations may request access to or export of their data in accordance with the relevant service and applicable policies.
Specific retention and deletion arrangements may be described in the Kitabu Yetu Privacy Policy or applicable subscription agreement.
21. Disclaimers
Kitabu Yetu will make reasonable efforts to provide reliable and accurate services.
However, to the extent permitted by law, we do not guarantee that:
- the Platform will always be available;
- all information will always be complete or error-free;
- every transaction will be successful;
- third-party integrations will always operate without interruption;
- the Platform will be completely free from bugs or vulnerabilities; or
- the service will meet every particular requirement of every user or organization.
Kitabu Yetu should be used together with appropriate organizational controls, review, reconciliation, and oversight.
22. Limitation of Liability
To the extent permitted by applicable law, Kitabu Yetu will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of or inability to use the Platform.
This may include losses arising from:
- interruption of service;
- telecommunications or internet failures;
- third-party payment failures;
- unauthorized access resulting from compromised user credentials;
- inaccurate information supplied by users;
- actions of group officials or organization administrators;
- loss of anticipated revenue or opportunities; or
- events outside Kitabu Yetu's reasonable control.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
23. Governing Law
These Terms and Conditions are governed by the laws of the Republic of Kenya.
Any dispute arising from the use of Kitabu Yetu will be handled in accordance with applicable Kenyan law and the applicable dispute-resolution mechanisms agreed between the parties.
24. Changes to These Terms
Kitabu Yetu may update these Terms from time to time to reflect changes in:
- the Platform;
- products and services;
- applicable laws;
- security requirements;
- business operations; or
- other relevant circumstances.
The latest version will be made available through the appropriate Kitabu Yetu channels.
Where a change materially affects users, we will take reasonable steps to provide notice where required.
Your continued use of Kitabu Yetu after the effective date of updated Terms constitutes acceptance of the revised Terms, subject to applicable law.
25. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the extent necessary to make it enforceable where legally possible.
The remaining provisions will continue to apply.
26. Waiver
If Kitabu Yetu does not immediately enforce a particular provision or right under these Terms, this does not constitute a permanent waiver of that provision or right.
We may enforce it at a later time.
27. Entire Agreement
These Terms, together with the Kitabu Yetu Privacy Policy, applicable subscription terms, product-specific terms, and any other agreements expressly incorporated by reference, constitute the agreement governing your use of the relevant Kitabu Yetu services.
Where there is a conflict between these Terms and a specific written agreement applicable to an enterprise, organization, or other customer, the specific agreement may prevail to the extent expressly provided.
28. Customer Support
If you have questions, experience a technical problem, identify a payment issue, or require assistance with Kitabu Yetu, you may contact our support team through the customer-support channels published on the Kitabu Yetu website.
For account-security issues, users should provide sufficient information for Kitabu Yetu to identify and investigate the issue without unnecessarily disclosing sensitive credentials.
